1. Agreement to Terms

By accessing or using the Mailchimp MCP service ("Service") operated by Alien Lifestyles ("we," "our," or "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Alien Lifestyles. Your use of the Service constitutes acceptance of these Terms, our Privacy Policy, and all other applicable policies.

2. Description of Service

The Mailchimp MCP (Model Context Protocol) service is a software integration that:

  • Connects Mailchimp accounts with Claude Desktop and Claude AI
  • Provides read and write access to Mailchimp data through MCP tools
  • Manages user accounts, license keys, and device registrations
  • Processes payments for premium features through Stripe
  • Stores OAuth tokens for Mailchimp API access

The Service acts as an intermediary between your Mailchimp account and Claude Desktop/Claude AI. We do not control how Claude AI or Claude Desktop processes or stores your data.

3. Eligibility and Account Registration

3.1 Eligibility

You must be:

  • At least 18 years old (or the age of majority in your jurisdiction)
  • Legally capable of entering into binding contracts
  • Authorized to use the Mailchimp account you connect
  • Compliant with all applicable laws and regulations

3.2 Account Creation

Account Requirements:

  • You must provide accurate, current, and complete information
  • You must maintain and update your account information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities under your account

Account Types:

  • Free Accounts: Limited to read-only access to Mailchimp data
  • Paid Accounts: Full read/write access, campaign sending, and advanced features

3.3 License Keys

  • License keys are provided upon account creation or subscription purchase
  • License keys are personal and non-transferable
  • You must not share your license key with others
  • License keys may be revoked for violation of these Terms

4. Acceptable Use

4.1 Permitted Use

You may use the Service to:

  • Access and manage your own Mailchimp account data
  • Integrate Mailchimp with Claude Desktop and Claude AI
  • Automate Mailchimp operations through MCP tools
  • Manage email marketing campaigns and audiences

4.2 Prohibited Activities

You must NOT:

  1. Violate Laws: Use the Service in violation of any applicable laws or regulations
  2. Unauthorized Access: Access accounts or data you are not authorized to access
  3. Malicious Activity: Use the Service to harm, disrupt, or interfere with systems or services
  4. Spam or Abuse: Use the Service to send spam, unsolicited emails, or engage in abusive practices
  5. Reverse Engineering: Reverse engineer, decompile, or disassemble the Service
  6. License Sharing: Share, sell, or transfer your license key to others
  7. Circumvention: Attempt to circumvent license restrictions or security measures
  8. Data Mining: Use automated tools to scrape or extract data beyond normal usage
  9. Impersonation: Impersonate others or provide false information
  10. Violate Third-Party Rights: Infringe on intellectual property or privacy rights

4.3 Mailchimp Compliance

You must:

  • Comply with Mailchimp's Terms of Use and Acceptable Use Policy
  • Comply with applicable email marketing laws (CAN-SPAM, GDPR, CCPA, etc.)
  • Obtain proper consent before sending marketing emails
  • Honor unsubscribe requests promptly
  • Maintain accurate sender information

4.4 Data Protection Compliance

You are responsible for:

  • Ensuring compliance with GDPR, CCPA, and other data protection laws
  • Obtaining proper consent for data processing
  • Protecting personal data accessed through the Service
  • Understanding that Mailchimp data is transmitted to Claude Desktop and Claude AI
  • Using PII masking features when handling sensitive data

5. License Restrictions

5.1 Free License

Free licenses provide:

  • Read-only access to Mailchimp data
  • Limited to viewing audiences, members, campaigns, and reports
  • No write operations (create, update, delete)
  • No campaign sending capabilities

Free license restrictions:

  • Device limits may apply
  • Some features may be unavailable
  • Support may be limited

5.2 Paid License

Paid licenses provide:

  • Full read and write access
  • Campaign creation and sending
  • Advanced features and tools
  • Priority support

Paid license terms:

  • Subscription-based (monthly or annual)
  • Automatically renews unless cancelled
  • Subject to Stripe's payment terms

5.3 License Enforcement

We reserve the right to:

  • Validate license keys at any time
  • Revoke licenses for violation of these Terms
  • Enforce device limits
  • Monitor usage for compliance

6. Intellectual Property

6.1 Our Rights

The Service, including all software, code, designs, logos, and content, is owned by Alien Lifestyles and protected by intellectual property laws.

You may NOT:

  • Copy, modify, or distribute the Service
  • Create derivative works
  • Remove copyright notices
  • Use our trademarks without permission

6.2 Your Rights

You retain ownership of:

  • Your Mailchimp account data
  • Content you create using the Service
  • Your account information

You grant us:

  • License to access your Mailchimp account via OAuth tokens
  • License to process your data to provide the Service
  • License to use anonymized data for service improvement

7. Third-Party Services

7.1 Mailchimp

  • The Service integrates with Mailchimp through their API
  • Mailchimp's Terms of Use and Privacy Policy apply to your Mailchimp account
  • We are not responsible for Mailchimp's services or policies
  • Mailchimp may change their API or terms at any time

7.2 Claude Desktop and Claude AI

  • The Service transmits data to Claude Desktop and Claude AI
  • Anthropic's Terms of Use and Privacy Policy apply to Claude AI
  • We are not responsible for how Claude AI processes or stores your data
  • Claude Desktop stores conversation history locally on your device

7.3 Stripe

  • Payment processing is handled by Stripe
  • Stripe's Terms of Service and Privacy Policy apply to payments
  • We are not responsible for Stripe's services or policies

8. Payment Terms

8.1 Subscription Fees

  • Subscription fees are charged in advance
  • Fees are non-refundable except as required by law
  • Prices may change with 30 days' notice

8.2 Payment Processing

  • Payments are processed by Stripe
  • You authorize us to charge your payment method
  • You are responsible for maintaining valid payment information

8.3 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods except as required by law
  • Refunds are processed according to Stripe's policies

8.4 Failed Payments

  • Failed payments may result in service suspension
  • We will attempt to notify you of payment issues
  • Service will be restored upon successful payment

9. Privacy and Data Protection

9.1 Privacy Policy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

By using the Service, you consent to:

  • Collection and processing of your data as described in the Privacy Policy
  • Transmission of Mailchimp data to Claude Desktop and Claude AI
  • Storage of conversation history locally on your device
  • Processing of data by third-party service providers

9.2 Data Security

  • We implement security measures to protect your data
  • However, no system is 100% secure
  • You are responsible for:
    • Using strong passwords
    • Keeping your license key secure
    • Enabling PII masking when appropriate
    • Securing your local device

9.3 Data Breaches

  • We will notify you of data breaches as required by law
  • We will take reasonable steps to mitigate breaches
  • You are responsible for monitoring your account for suspicious activity

10. Disclaimers and Limitations of Liability

10.1 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

  • Uninterrupted or error-free service
  • That the Service will meet your requirements
  • That data will be accurate or complete
  • That the Service will be secure or free from viruses

10.2 Third-Party Services

We are not responsible for:

  • Mailchimp's services, availability, or data accuracy
  • Claude AI's processing or storage of your data
  • Stripe's payment processing or policies
  • Claude Desktop's local storage or security
  • Any third-party service failures or issues

10.3 Data Loss

We are not liable for:

  • Loss of data due to service interruptions
  • Loss of data due to user error
  • Loss of data due to third-party service failures
  • Loss of data stored locally in Claude Desktop

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability is limited to the amount you paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for loss of profits, data, or business opportunities

Some jurisdictions do not allow limitations of liability, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Alien Lifestyles, its officers, directors, employees, and agents from:

  • Any claims arising from your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations
  • Any data breaches or security incidents caused by your actions

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Cancelling your subscription (if applicable)
  • Deleting your account through account settings
  • Contacting us at support@alienlifestyles.com

12.2 Termination by Us

We may terminate or suspend your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • You fail to pay subscription fees
  • We discontinue the Service
  • Required by law or court order

12.3 Effect of Termination

Upon termination:

  • Your access to the Service will be revoked
  • Your license key will be revoked
  • Your OAuth tokens will be revoked (Mailchimp connection will be disconnected)
  • Your data will be deleted according to our Data Retention Policy
  • You will not be entitled to refunds (except as required by law)

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

13.2 Dispute Resolution Process

Before filing a claim, you agree to:

  1. Contact us at support@alienlifestyles.com to attempt to resolve the dispute
  2. Provide 30 days for us to respond and attempt resolution
  3. Engage in good faith negotiations

13.3 Arbitration

If disputes cannot be resolved:

  • Disputes will be resolved through binding arbitration

Some jurisdictions do not allow arbitration clauses, so this may not apply to you.

14. Changes to Terms

  • Sending email notifications for material changes

Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms, together with our Privacy Policy and other applicable policies, constitute the entire agreement between you and Alien Lifestyles.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

15.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

15.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

17. Agreement by Use

  2. You have read and understood our Privacy Policy
  3. You understand that Mailchimp data is transmitted to Claude Desktop and Claude AI
  4. You understand the risks associated with PII exposure
  5. You are responsible for compliance with applicable laws
  6. You are authorized to use the Mailchimp account you connect
  7. You will not violate these Terms or any applicable laws

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
